RATES & BOOKINGS
Rates are quoted hourly, half-day, full-day, or as otherwise negotiated. A two-hour minimum applies to all bookings, billed in full-hour increments. Time worked more than 15 minutes into the next hour is billed as a full additional hour. Rates cover use in Australia and New Zealand for 12 months from first use, unless otherwise agreed in writing.
Underwear bookings attract a minimum of double the Talent's standard rate, or a rate otherwise agreed, and must be cleared with the Talent and approved by Silverfox before confirmation.
A 20% Agency Service Fee (ASF) applies to all bookings, payable by the Client on top of the Talent fee.
STANDARD BOOKING DAY
A standard day is 8 consecutive hours, exclusive of lunch. Work before 9:00am, after 5:30pm, or beyond 8 hours is charged at time and a half unless otherwise negotiated. Weekend and public holiday rates are negotiated separately. Time worked more than 15 minutes into the next hour is billed as a full additional hour. USAGE & IMAGE RIGHTS
Quoted fees cover shoot time only. Usage beyond the primary purpose — including outdoor advertising, point-of-sale, packaging, print inserts, and similar formats — requires separate negotiation and payment. Some product categories (including lingerie, alcohol, and personal care) attract higher rates. Content may not be reused for a different purpose, campaign, or client without Silverfox's written agreement and an additional fee. Usage is limited to Australia and New Zealand unless otherwise agreed in writing.
No usage rights are granted until the relevant fee is agreed and the invoice paid in full. Use outside the agreed scope is unauthorised and may attract a penalty fee and other remedies, including under the Copyright Act 1968 (Cth). The Client must ensure the photographer or production company is made aware of these terms before the shoot. Test or portfolio photography may not be used commercially without Silverfox's prior written agreement.
SOCIAL MEDIA
Social media usage is not included in fees unless expressly agreed in writing. Where product is supplied to the Talent for content creation, the Client covers return postage or courier costs. Posts must use the Client's specified hashtags and disclosures and clearly identify the brand. The Client may share content once on its own channels; further use requires separate written agreement. No third-party use is permitted without Silverfox's prior written consent.
ARTIFICIAL INTELLIGENCE
The Client must not use any audio-visual records, photographs, or likeness of the Talent for purposes other than as specified in the booking confirmation. The Client must not use any recording, photograph, or likeness of the Talent to train or prompt AI systems, or to create a synthetic, digitally altered, or digital double version of the Talent, without the Talent's prior written consent obtained through Silverfox.
EXCLUSIVITY
Bookings are non-exclusive by default, unless agreed and paid for at an additional fee. Without a paid exclusivity arrangement, the Talent remains free to work with competing brands, including immediately before or after this booking. Clients must check for conflicts with Silverfox at the time of booking.
HOLDS & CONFIRMATION
Holds must be confirmed or released at least one business day before the relevant date, or the date may be released without notice. A booking is only confirmed once the Client returns a signed booking confirmation to Silverfox.
CANCELLATIONS
Cancellation within one business day of the booking incurs the full fee. For multi-day bookings, the required notice period matches the length of the booking (for example, a 3-day booking requires 3 business days' notice); otherwise the full fee applies.
WEATHER-DEPENDENT BOOKINGS
First weather reschedule: no fee. Second weather reschedule: half fee. Third weather reschedule: full fee. The full fee applies regardless if the same Talent is not rebooked for the rescheduled date.
ADDITIONAL TIME
Hair, makeup, fittings, rehearsals, wardrobe checks, and recalls are charged at the standard rate or as otherwise negotiated. Travel time is charged at the standard rate for travel beyond 25km from the closest major city GPO.
MEALS
The Client is responsible for providing or covering the cost of meals on full-day shoots and on all bookings outside the metropolitan area.
COMPLAINTS
Complaints should be raised during the booking or as soon as reasonably possible after. Complaints raised well after the fact, where they could reasonably have been raised at the time, may not be capable of proper investigation and Silverfox reserves the right to decline to act on them in those circumstances.
INSURANCE, TAX & SUPERANNUATION
Silverfox acts as agent for the Talent and is not their employer. The Client, as end user of the Talent's services, is responsible for its own taxation and statutory obligations as follows:
PAYG Withholding: Under the ATO's PAYG Withholding Guidelines for Performing Artists, Agents, Advertising Agencies and Advertisers, and consistent with the ATO's guidance on work arranged by intermediaries (SGR 2005/2), the Client as end user is the party responsible for any applicable PAYG withholding obligations on Talent fees, unless otherwise agreed with Silverfox in writing. Silverfox's role is that of agent only; it does not assume withholding obligations on behalf of the Client.
Superannuation: Superannuation Guarantee contributions, where applicable under the Superannuation Guarantee (Administration) Act 1992 (Cth), are the responsibility of the Client as the engaging party and are not included in quoted Talent fees. Where superannuation is payable, it will be charged to the Client in addition to the Talent fee and the Agency Service Fee, at the current legislated rate. This reflects the ATO's position under Superannuation Guarantee Ruling SGR 2005/1 and SGR 2005/2, under which the obligation to make superannuation contributions rests with the party engaging and paying the Talent for their services. Silverfox, acting solely as agent, does not accept liability for superannuation contributions on behalf of the Client.
Workers' Compensation & Public Liability: Silverfox holds no insurance for the Talent. The Client is solely responsible for maintaining adequate Workers' Compensation and Public Liability cover at every location where the Talent performs services under this booking.
GST
GST applies at the prevailing rate (currently 10%) on the Agency Service Fee and any other taxable supply made under these terms.
PAYMENT TERMS
Invoices are due within 30 days of the date of issue. A late fee of 2% per month applies to overdue amounts after that date. Silverfox reserves the right to refer overdue accounts to a collection agency, with all associated costs payable by the Client.
